Terms of Use
Terms of Use
Effective July 15, 2026
These Terms of Use govern your access to and use of the K Metal Work & Design website at kmetalwork.com and the services offered through it. By using the site, requesting a quote, or creating an account, you agree to these terms. The specific terms of any fabrication or installation project are governed by the signed contract or accepted quote for that project, which controls over these general terms where they conflict.
1. About us
K Metal Work & Design is a custom metal fabrication and design firm based in Downey, California, serving Southern California. We are licensed and regulated by the California Contractors State License Board (CSLB); our license number appears on our contracts and is available on request.
2. Quotes, estimates & contracts
Quotes and estimates provided through this site are offers valid for the stated period and are not binding contracts until accepted by you and, where required, countersigned by us. Pricing, material costs, and lead times are subject to reconfirmation after a quote’s validity period. A project becomes binding only on the terms of the accepted quote or signed contract, including its scope, payment schedule, and legal notices. For residential home-improvement work, your statutory rights — including the applicable right to cancel — are set out in that contract and are not waived by these Terms.
3. Deposits & payment
Where a deposit is required, the amount and timing are stated in your quote or contract. Deposits and payments may be made online through our payment partners or by other means we make available. We never collect a deposit that exceeds the amount permitted by law for the type of work. Payment obligations, refunds, and cancellation are governed by your contract.
4. Customer portal & accounts
If you create a customer portal account, you are responsible for keeping your login credentials confidential and for activity under your account. Notify us promptly of any unauthorized use.
5. Acceptable use
You agree not to:
- Use the site for any unlawful purpose;
- Attempt to gain unauthorized access to our systems, accounts, or data;
- Interfere with or disrupt the site, or introduce malicious code;
- Scrape, copy, or reproduce site content except as permitted by law.
6. Intellectual property
The site, its content, our name, logo, designs, and photographs are owned by K Metal Work & Design or our licensors and are protected by intellectual-property laws. You may not use them without our written permission. Design drawings, shop drawings, and engineering prepared for a project remain our property unless the contract states otherwise.
7. Warranties & disclaimers
Our workmanship warranty, if any, is set out in your project contract. Except as expressly stated there or required by law, the website and its content are provided “as is” without warranties of any kind. Nothing in these Terms limits any non-waivable statutory right you have as a consumer under California law.
8. Limitation of liability
To the fullest extent permitted by law, K Metal Work & Design is not liable for indirect, incidental, or consequential damages arising from your use of the website. This section does not limit liability for personal injury, gross negligence, fraud, or any liability that cannot be limited under California law, and does not affect the terms of your project contract.
9. Governing law & disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute relating to the website will be resolved in the state or federal courts located in Los Angeles County, California, unless your project contract provides otherwise.
10. Changes
We may update these Terms from time to time. The “Effective” date above reflects the current version; continued use of the site constitutes acceptance of the updated Terms.
